You may create a Card by completing a card-creator tutorial and agreeing to comply at all times with the Sphir Policies. You can review our card creator tutorials via the HELP page.
You may populate a digital card on the Website with Content (a “Card”) related to a specific business, entity, topic, event, service, product, commercial offering, etc. By creating a Card, you represent and agree that all Content is consistent with the Sphir Policies and does not violate the laws, rules, or regulations of the United States of America or of any country, state, or local jurisdiction. Please read our Content and Behavior Guidelines for more information about our Content expectations, requirements, and prohibitions.
If the Content of a Card contains: (a) your original Content, or (b) information specific to a business or entity that you control or own, you may “claim” that Card. By claiming a Card, you represent to us and other users that you are the rightful owner of the Card (or the designated agent of the entity or organization with authority to claim, verify, and/or manage the Card for such entity or organization).
If you cease to own or control the entity or organization that has claimed a Card, you must transfer ownership of the Card to the new owner. To transfer ownership, email us at Cards@Sphir.io.
If you believe that a Card, which contains your original Content or information specific to your entity or organization, was inappropriately claimed by another user, please notify us promptly by “flagging” the disputed Card and providing details of the dispute. We will investigate.
If you are a copyright owner or agent thereof and believe that Content on a Card has been inappropriately claimed by another user and/or infringes upon your copyright, please submit a notice following our DMCA Guidelines. If you fail to comply with all requirements of the DMCA for notifications, we may not act on your communication.
Any recommendation, endorsement, or testimonial on a Card (or otherwise made on the Website) must comply with the U.S. Federal Trade Commission’s (the “FTC”).com Disclosures Guide , the FTC’s Native Advertising Guidelines , and the FTC’s Guidelines Concerning the Use of Testimonials and Endorsements in Advertising , and any other guidelines issued by the FTC from time to time (“FTC Guidelines”), as well as any other advertising guidelines required under applicable law. For example, if you have been paid or provided with free products in exchange for recommending, discussing, or promoting a product or service on the Website, or if you are an employee of a company and you decide to recommend, discuss, or promote that company’s products or services on the Website, you agree to comply with the FTC Guidelines’ requirements for disclosing such relationships. You are solely responsible for any recommendations, endorsements, or testimonials you make regarding any product or service on the Website. We do not have any liability for recommendations, endorsement, or testimonials on the Website.
Although we do not charge to create or claim Content, we reserve the right to charge fees for e-commerce transactions made through the Website and for ancillary services including video storage, streaming, etc.
If you offer any promotions, contests, or other giveaways (collectively, the “Promotions”), you agree to (a) ensure that the terms of the Promotions meet the requirements of the law; (b) clearly identify all terms, guidelines, qualifications, timeframes, and expectations of such Promotions; and (c) adhere to any promise made in your Promotions, given or implied. We do not endorse or monitor any Promotions or resolve any disputes related to Promotions. We do not have any liability relating to Promotions. By offering Promotions, you agree to take full and complete responsibility to determine and comply with the terms of your Promotions. If we find that you have violated any of the Sphir Policies in connection with a Promotion, we reserve the right to deactivate and/or delete your Card and/or your account without liability.
We may revise the Sphir Policies (including these Card Guidelines) in whole or in part, by posting the revised Sphir Policies on the Website. Your continued access or use of the Website after the effective date of the revised Sphir Policies constitutes your acceptance of the terms. Changes to Sphir Policies do not apply retroactively.
